On September 30, 2021, the European Commission decided to open an infringement procedure in the framework of the regular review of the transposition by sending a letter of formal notice* to to Belgium, Bulgaria, Czech Republic, Spain, Estonia, Croatia, Ireland, Italy, Cyprus, Latvia, Luxembourg, Hungary, Netherlands, Austria, Romania, Slovenia, Slovakia, Finland and Sweden.

* Letter ordering non-compliant Member States to consider a specific EC obligation in their national law within 2 months.

Some member states have not provided complete information on how the revised EU rules on open data and the re-use of public sector information (Directive (EU) 2019/1024) are transposed into national law.

The Open Data and Reuse of Public Sector Information Directive, adopted on June 20, 2019, aims to facilitate access to and reuse of data produced by public bodies.

The directive will stimulate the development of innovative solutions such as mobility applications, increase transparency by opening access to publicly funded research data, and support new technologies, including artificial intelligence. Member states were required to transpose this directive into their national legislation and notify the Commission of the transposition measures by 17 July 2021.

 

Deadline: 30/11/2021

These Member States must now respond to the letters and take the necessary measures before the deadline set by the European Commission. In the absence of a satisfactory response, the European Commission may decide to issue reasoned opinions (see 2nd step).
